Measure T Overturned- March 13, 2025

Measure T, the 2018 South Lake Tahoe voter-approved ordinance restricting short-term rentals in residential areas, was overturned by an El Dorado County Superior Court ruling in March 2025. The court found the permanent resident exception unconstitutional under the Dormant Commerce Clause, finding it discriminatory against non-residents. The city chose not to appeal the ruling and subsequently adopted a new short-term rental (STR) ordinance in June 2025, which includes provisions like noise monitors and a new permitting structure.    

Entire measure nullified: The judge ruled that the resident exception was so fundamental to the measure that it could not be removed without invalidating the entire ordinance. As a result, the entire voter-approved measure was struck down. 

New regulations and current status

  • Moratorium on new permits: Following the ruling, the South Lake Tahoe City Council voted against an appeal and implemented a moratorium on new STR permits in residential areas to allow time to draft a new ordinance.

  • New ordinance adopted: In June 2025, the city council adopted a new set of STR regulations, which took effect in July 2025.

  • Permits reissued: The new ordinance allows the city to issue a limited number of STR permits in residential areas again. Applications for former permit holders started in late June 2025, and applications for the general public began in August 2025

On June 2nd the El Dorado Supervisors held a special meeting to discuss when vacation rental homes can be opened.
El Dorado County is waiting for Governor Newson to declare California is in Stage 3 and is planning to be ready to open as soon as Stage 3 is announced.
There is no question that businesses in South Lake Tahoe have been hit hard financially from the absence of visitors. The Supervisors discuss readiness plans and best options to communicate them to the Governor in the meeting.

The meeting allowed public comment and Lisa Underwood expressed the following: (Listen at at 1hour 52 minutes)
”My name is Lisa Underwood.  I am a partner in Tahoe Keys Resort – a vacation rental company that has been in business in Tahoe since 1992.  I am also a member of the Lodging Association.  I support all comments here today from our lodging industry and do encourage you to understand the importance of our hotels and VHRs being allowed to host visitors again.  We have not been idle during the past months but we have been educating ourselves, reworking our policies and procedures and making plans for keeping our guests, our employees and our communities safe.  In Tahoe many of us only make money 5-6 months out of the year.  Four of those months are sequential and the count began yesterday.  We cannot sustain without summer business.  When we were asked to comply to help flatten the curve – we stepped up to the challenge.  Now we are asking you to help us – the business community -survive.  Without summer many of us will not.  We need a definitive opening date and we need it now.”


Measure T - Update - September 3rd 2019

South Lake Tahoe City Council votes to defend Measure T in court.

South Lake Tahoe City Council unanimously decided to defend the city’s voter-approved vacation home rental ban against a lawsuit.
The 5-0 vote to defend Measure T came in closed session Tuesday morning. 
City attorney Heather Stroud read out the action at the start of the open session meeting.
Council conveyed that it recognizes the will of the voters, who approved Measure T in 2018 by 58 votes. It also stated that council recognizes the issue may not be resolved by the lawsuit and that future ballot initiatives could be a possibility.
Following passage of Measure T, which will ban VHRs outside of the tourist core and commercial zones, a group called the South Lake Tahoe Property Owners Group filed a lawsuit claiming the measure is unconstitutional.
The city had sought to try and find a compromise ballot measure to settle the lawsuit. However, the group that put Measure T on the ballot refused to back a proposed compromise.

What does this mean for you as a vacation rental home owner?
Tahoe Keys Resort is contributing to the STOP T legal fund.
As the article states this group will now move forward with the lawsuit against the city as well as potentially now put efforts into a new Ballot initiative to overturn Measure T for Nov 2020.

The City Continues Work Toward Sustainable Compromise on VHR Issue
Measure T, which enacted new VHR regulations in South Lake Tahoe, was approved by the voters in November 2018 and went into effect in December 2018.
The key provisions of Measure T include a prohibition on the issuance of new VHR permits in residential areas, the phase-out of existing VHR permits in residential areas in 2021, and an immediate reduction in the maximum occupancy limits in permitted VHRs.

In late December, a lawsuit was filed to overturn Measure T, and this lawsuit is still pending.
A subsequent agreement has delayed the implementation of the new maximum occupancy limits until the case is decided, and pre-Measure T maximum occupancy limits remain in effect. In the meantime, the City and the plaintiffs have agreed to enter into formal mediation later this year in an attempt to reach a sustainable compromise on this issue and resolve the lawsuit without a trial.

City staff have been working with interest groups on both sides of the VHR issue in recent months in an attempt to identify a sustainable compromise that will be supported by the vast majority in our community in a future ballot initiative. If this effort is successful, it is anticipated that a new City-sponsored ballot initiative will be presented to the voters within the next year. If this effort is not successful, it is likely that the Court will decide the case within the next year.

City staff are working diligently to identify a potential sustainable compromise in an effort to bring our community together on this divisive issue, protect and promote the residential character of SLT neighborhoods, and promote a strong tourism economy.

In addition, the City expects to lose approximately $2 - $3 million of annual transient occupancy tax revenue if / when Measure T is fully implemented, and this revenue is critical to the City’s ability to fund the proper investment in our core services (Police, Fire, street maintenance, and snow removal).
